Terms of Service

These Terms of Service (“Terms”) govern your use of the Good Baby Bad Baby mobile app and related services (the “Service”) operated by pbpublishingllc(“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is not directed to children under 13.

2. Your Account

• Provide accurate information when creating an account.
• Keep your credentials secure. You are responsible for activity under your account.
• One account per person. Do not share, sell, or transfer accounts.
• Notify us immediately at support@goodbabybadbaby.com if you suspect unauthorized access.

3. Your Content

You retain ownership of the photos, videos, captions, and other material you submit (“User Content”). By posting User Content, you grant pbpublishingllc a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, perform, distribute, adapt, and modify your User Content for the purpose of operating, providing, promoting, and improving the Service, and for the distribution and display of User Content to other users. This license continues for as long as your User Content remains on the Service and for a reasonable period after its removal to allow for backup completion and account wind-down.

You represent and warrant that you own or have the necessary rights to the User Content you post and that it does not violate the rights of any third party or any law.

4. Acceptable Use

You agree not to:

• Post content that is unlawful, threatening, harassing, defamatory, obscene, hateful, or violent.
• Post sexually explicit material or content depicting animal abuse, neglect, or cruelty.
• Post content that infringes intellectual property, privacy, or publicity rights.
• Impersonate any person or misrepresent your affiliation with any person or entity.
• Post spam, scams, or repetitive low-quality content; buy, sell, or artificially inflate engagement.
• Interfere with or disrupt the Service, probe for vulnerabilities, or circumvent rate limits or other security measures.
• Use automated means (bots, scrapers) to access the Service without our prior written permission.
• Collect information about other users without their consent.
• Use the Service to violate any law or regulation.

5. Moderation and Enforcement

We may, at our discretion and without obligation, review User Content and reports, remove content, suspend or terminate accounts, and take any action we believe is appropriate to protect the Service and its users. We are not a publisher of User Content and do not endorse content posted by users.

6. Intellectual Property

The Service, including its software, designs, logos, and other materials (excluding User Content), is owned by pbpublishingllc or its licensors and is protected by intellectual property laws. Except for the limited license to use the Service under these Terms, no rights are granted to you.

7. Advertising

The Service may display advertisements, including from third-party ad networks. Your interactions with advertisers are between you and the advertiser; we are not responsible for their products, services, or practices.

8. Termination

You may delete your account at any time from app settings. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, sections 3 (User Content license, for the limited period described), 6, 9, 10, 11, 13, and 14 survive.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PBPUBLISHINGLLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless pbpublishingllc and its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

12. DMCA and Copyright

If you believe content on the Service infringes your copyright, send a notice to support@goodbabybadbaby.com that includes:

• Your physical or electronic signature.
• Identification of the copyrighted work claimed to be infringed.
• Identification of the infringing material and its location on the Service.
• Your address, telephone number, and email address.
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the owner.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to personal jurisdiction in those courts.

14. Changes to These Terms

We may modify these Terms from time to time. Material changes will be announced through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
